ACCOUNT OPENING

To place a bet or play a game through our Services, it is necessary to open an account. By opening an Account and using the Service, you confirm that:

(a) you are 18 years of age or older (gambling is a criminal offense for anyone under the age of 18);

(b) it has the legal capacity to enter into binding contracts;

(c) you are a resident of Mozambique, where it is legal to open an account with us and use our Services;

(c) you are the person you claim to be on your record and provide correct, current and complete information, committing to promptly update any information that may change;

(d) acts on your behalf and not on behalf of another person;

(e) you have not previously had an account that has been closed by us or any other game operator because of infringement, misuse or illegal behavior;

(f) you are not prohibited, for any reason, from betting with us or using the Services; and

(g) you have not banned yourself, and you have not been banned by any third party, from playing games of chance. When you open your Account, you will be asked to provide personal details, which include your name and date of birth as well as contact information.

It is your responsibility to ensure that your Account with us contains correct personal/financial information. By sending us the payment details, you guarantee that you have the right to carry out the transaction in question or to place the bet in question with the payment details provided. If we do not receive authorization for payment or if payment is not valid, it cannot be processed otherwise or if any authorization is subsequently withdrawn we may refuse your transaction or bet and/or immediately cancel or suspend your Account.

You may only open one Account with us, which you may use for the purposes of the Services. We reserve the right to close any duplicate Accounts and to cancel any bets or transactions on duplicate Accounts. We also reserve the right to suspend or close any Account and cancel any bet or associated transaction where the Account holder and the owner of the funding instrument are not the same.

ACCOUNT SECURITY

If you choose, or have a password, or any other item of information as part of our security procedures, you must treat that information as confidential and you may not disclose it to any third parties.

It is your responsibility to maintain the confidentiality of your password and you are fully responsible for all activities carried out under your username and password. Any username and password you choose or provide to access the Services shall be for your personal use only and is not transferable. We recommend that you disable any automatic password memory in your browser before using the Site. This will help to reduce the risk of unauthorized use of your Account.

(a) promptly notify us of any unauthorized use of your username and/or password, or any other breach of security; is on

(b) ensure that you log out of your Account at the end of each session. We cannot and will not be liable for any loss or damage resulting from your failure to comply with the requirements of this clause.

If you do not remember or have lost your password or account details, please contact us immediately. We will use commercially reasonable efforts to suspend your Account as soon as we become aware of the loss of your Account data, but you remain solely responsible for bets placed on your Account prior to the suspension of your Account. If we have reason to believe that this is a breach of security or misuse of your account, we may require you to change your password/registration data or we may suspend or terminate your Account without notice.

We have the right to disable, suspend or restrict your username or password, whether chosen by you or assigned by us, at any time in our sole discretion, including if, in our opinion, you have failed to comply with any of the provisions of this Agreement.

Can not:

(a) enter, select or use a false name, address or Account data or an email address owned or controlled by another person with the intent to impersonate that person, or

(b) use a name or such data without proper authorization. We do not accept any liability resulting from any unauthorized use of our Site and/or Services that is fraudulent or otherwise. We reserve the right, in our sole discretion, to refuse registration, suspend or cancel a username without notice.

RISK

You agree and confirm that you are fully aware that there is a risk of losing money in gambling games through the Site and/or Services and that you are entirely responsible for any loss.

ERRORS

We accept no responsibility for any errors with respect to advertisements, publications or pricing, limitations, conditions, betting information or results, although we make every effort to ensure their accuracy. We make every effort to ensure that there are no errors in the prices offered or bets accepted. However, human and/or systems errors may occasionally result in errors. We reserve the right to correct any obvious errors and to void any bets placed where this has occurred. In the event of gross errors in the prices transmitted (when, for example, the displayed price is substantially different from the prices available on the general market and/or the price is clearly incorrect, depending on all circumstances), bets will be placed with the correct price at the time of acceptance. If a bet is accepted by us on an event where the proposing price on the event itself (and not the price) was in error, the bet will be void and your amount will be refunded.

If funds are credited to the wrong Customer Account, it is the customer's responsibility to notify us of the error without delay. Any winnings subsequent to the error and prior to notification to us, whether related to the error or not, will be deemed invalid and returned, or otherwise recovered, by us.

BETTING DISPUTES

Any question about a bet claim must first be sent to us using the contact details provided. We will make every effort to resolve the matter in a mutually satisfactory manner.

PLACE YOUR BETS

You must make your own judgment when deciding to place a bet. You are aware that, when placing a bet, you are not relying on any statement by any of our employees regarding the subject of the bet. We reserve the right to refuse a bet in whole or in part.

You agree to pay us for bets placed with us in accordance with the Terms and Conditions. You agree that you are solely responsible for any bets placed on your Account with us. You may only place bets on the Site through your Account and we do not accept bets placed otherwise or through other means in connection with the Services. Winnings resulting from using the Site or the Services will be deposited into your Account and subsequent bets placed on the Site will be deducted from your Account balance with us.

Customers can only bet up to the amount they have in their Account or the limit set out in the Betting Rules, whichever is lower. The minimum and maximum bet per selection is determined solely by us. To place a bet or access a service, you must follow the instructions provided in the Help section of the Site.

It is your responsibility to ensure that the details of any bet or transaction you make with the Services are correct.

We reserve the right to refuse, in whole or in part, any transaction you request at any time and in our sole discretion, or in the event of non-compliance with the terms and conditions. We do not accept any transaction until we have received proper confirmation (or have otherwise accepted it).

Once you have placed your bet and received confirmation that it has been accepted, it will be too late to cancel the bet (unless we, in our sole discretion, have authorized the bet to be canceled or changed). At that time you have granted us irrevocable authority to hold your funds until the results of the event are known and to withhold, refund or pay out winnings in relation to the bet in accordance with the betting rules applicable thereto and these Terms and Conditions.

When bets are placed after the event has started, bets stand if nothing has happened that significantly changes the odds of the selection winning or losing. All bets placed after the outcome of an event is known will be void (whether they win or lose). We reserve the right to void any bet inadvertently accepted after bets have been settled, or in the event that the event has ended or in a situation where the customer may have an indication of the outcome. We also reserve the right to void any bet that has been placed after an event has actually started. This applies even if the time has been incorrectly advertised by us, in the press or otherwise. In the event of dispute over the time a bet was placed or whether a bet was placed, the time at which it was recorded (if recorded) in our transactional record will govern. If an attempted bet has not been recorded in the transaction log, the bet will not be considered to have been placed. You must check your Account balance each time you visit the Site.

It is important to familiarize yourself with gambling and betting terminology and how the various games and bets operate. If you have any queries, please contact us. We cannot accept any liability if you place a bet in circumstances where you do not fully understand the terms involved or how the bet or game operates. In the event that a representation made by you turns out to be false, you will forfeit your amount and we are not obligated to pay any winnings that might have been due in connection with the bet. Any queries you may have concerning a bet you have placed on the Site must be raised by you no later than six months after the last event in which the bet was placed. FRAUDULENT AND CANCELED BETS

We reserve the right to seek criminal or other sanctions against you if we suspect that you may have engaged in fraudulent, dishonest or criminal actions and we will disclose such information to competent authorities or other relevant entities (such as payment service providers ) that may be necessary in this regard. We reserve the right to suspend or close any account that we believe may be involved in fraudulent, money laundering and/or other illegal or suspicious activities, and to disclose such information if we reasonably believe it is necessary to the competent authorities.

We reserve the right to withhold payment due to you if we suspect that you may be involved in fraudulent, dishonest or criminal activities.

You shall indemnify us and are obliged to pay us, upon demand, all expenses, charges or losses suffered or incurred by us (including any direct, indirect or consequential damages, loss of profit and damages of reputation) resulting directly or indirectly from the their fraudulent, dishonest or criminal actions.

We reserve the right to refuse payment of any bet that we cannot verify from our security records. We reserve the right to void any bet if we believe it may not be in good faith or that it violates these Terms and Conditions, any of our betting rules or any rules of a sports regulatory body.

We reserve the right to limit or refuse any bet at our sole discretion for any reason. In circumstances where a bet is considered or declared void by us at our discretion, any amount deducted from your Account in respect of the bet will be credited to your Account. Bets will only be valid if accepted by our server. Until acceptance, no communication from you will be linked to us and all information presented on the Site only constitutes an invitation to deal with or dispose of the Services. If we decide to waive a rule in the interests of fair gaming for you, it should only apply to that specific event and should set a precedent for the future.

SUSPENSION OF AN ACCOUNT

We do not warrant or represent that all Services will be available to all customers. We may, in our sole discretion and without any requirement to give reasons, exclude any customer from the services in general or from receiving selected promotions and any other promotions and offers introduced by us from time to time. Without limiting our ability to use remedies that may be available to us, we may suspend or close your Account, withhold part or all of your Account balance, or cancel or void any bets or transactions you have made, in our sole discretion. , if:

(a) there is a technological failure that affects the integrity of a transaction or your Account;

(b) we suspect or become aware that you are involved in illegal or fraudulent activities while using the Services;

(c) we suspect or become aware that you have violated any of these Terms and Conditions or the rules governing a particular bet or transaction;

(d) we suspect or become aware that you are acting in a way that is detrimental to the conduct of our business, such as if you are improperly benefiting from us or any other player or are acting for another unfairly exploiting a flaw, loophole or error in our software or cheating or conniving others;

(e) we suspect or become aware that you may be experiencing difficulties in obtaining credit, going bankrupt or experiencing similar situations anywhere in the world;

(f) we believe there is a manifest error in the terms of a bet or transaction you have made;

(g) we become aware that you “returned” or declined any purchase or deposit you have made to your account; or

(h) we are required to do so by law.

CLOSING OF ACCOUNTS

If you wish to close your Account, please contact us. We will comply with your request within a reasonable period of time, but you will continue to assume responsibility for all activities on your Account until your Account is formally closed (i.e. until all bets and transactions have been placed and all amounts in the Account are paid or withdrawn in accordance with these Terms and Conditions).

We reserve the right to close your Account at our discretion and without having to give reasons in a written notice (or attempted notice) addressed to you using the contact information you have provided to us. Any balance in your Account that is not contested will be made available to you provided you have complied with these Terms and Conditions.

We can also close or suspend your Account without notice if your Account remains inactive for a significant period of time. If you do not use your Account to place bets or games, to make deposits or withdrawals, or if it is otherwise inactive for a period of at least 24 consecutive months, we will close it and return your balance to you provided it is not object of contestation.

If we cancel your account for any reason, we will have no liability to you whatsoever, other than returning any undisputed balance.

If we close your Account for failing to comply with any of the Terms and Conditions, your Account balance will not be refunded and will be deemed forfeited to the extent of any claim that we may have against you as of the date of termination (with respect to your Account or otherwise). We reserve the right to set off your Account balance to the extent necessary to meet any losses, damages, costs, expenses or liabilities arising from your default.

Closing your Account will not affect current bets as long as those bets are valid and provided they are not in breach of the Terms and Conditions in any way. If your Account has been closed or if you have expressed an intention to close your Account, any promotions, bonuses or other unclaimed benefits that may be communicated to you are automatically forfeited.

Upon termination of this Agreement, on your or our initiative, you agree and confirm that:

(a) your rights to use the Site and Services will be terminated immediately;

(b) cease any and all use of the Site and Services, and

(c) remove any software provided to you or downloaded in connection with the Site or Services from your computer, tablet, hard drives, networks or other storage device.

PERMITTED USE OF THE SITE AND SERVICES

You must not misuse the Site and/or the Services by knowingly or negligently introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Site and/or Services, the servers on which the Site or Services are stored, or any server, computer or database connected to the Site or Services. You must not attack the Site through a denial of service attack or a distributed denial of service attack. This violation constitutes a criminal offence. We may report this infringement to law enforcement authorities and we will cooperate with those authorities by revealing your identity and other data related to your account with us. If you commit this offence, your right to use the Site and Services will cease immediately.

The following practices are “Prohibited Practices” and are not permitted, constituting a material breach of the Terms and Conditions. We will take all reasonable steps to prevent and detect these practices and to identify the people who committed them if they occurred. However, subject to the provisions below, we will not be liable for any loss or damage you may incur as a result of any Prohibited Practices, and any action we take in connection therewith will be in our sole discretion. Prohibited Practices in relation to the Services:

(a) abuse of bonuses or other promotions; and/or

(b) using unfair external influences or factors (commonly known as cheating); and/or obtaining an unfair advantage;

(c) opening of duplicate Accounts; and/or

(d) carrying out fraudulent practices or criminal activities.

We have no obligation to monitor or moderate any user activity or use of the Site, however, we reserve the right at any time to monitor, retain and disclose any information as necessary to satisfy any law, regulation, legal process or request from applicable regulatory authorities, to ensure that the services are used correctly, that these Terms and Conditions are being complied with, or to investigate any suspected breach.

INTELLECTUAL PROPERTY RIGHTS

You acknowledge and agree that all intellectual property rights in our Site, its content (including any software) and the content posted on it, remain at all times owned by us or our licensors. These intellectual property rights include, but are not limited to, copyright, reproduction rights, trademarks, underlying software, design, graphics, layout, image and structure of our Site, database and design, domain names and rights to goodwill and/or to trigger the transfer. INDEPENDENCE OF PROVISIONS

If any of the Terms and Conditions is to any extent deemed invalid, illegal, void or unenforceable by a competent authority, that term, condition or provision will to that extent be removed from the remaining terms and conditions which will remain valid to the extent permitted by law.

YOUR PERSONAL DATA

We have the right to share the information we hold about you, which includes personal data and betting history, with the regulatory authority, sporting bodies and other bodies, including the police, in order to investigate matters relating to fraud, money laundering or integrity of sport, and to fulfill our regulatory duties.

LIABILITY AND INDEMNIFICATIONS

You agree that your use of the Site is at your own risk.

Our maximum liability to you arising under the Terms and Conditions, whether for breach of contract, tort (including negligence), or otherwise, will be limited to:

(a) the relevant stake amount for which the liability in question has arisen; and

(b) if the money you have paid into your Account has been misplaced by us, to return such amount to your Account. We will not be liable to you with respect to contract, tort (including negligence), breach of statutory duty or otherwise resulting from:

(a) business interruption, loss of profits, revenue, business, data, opportunities, business information or goodwill; or

(b) indirect or consequential losses arising out of or in connection with these Terms and Conditions, even if such losses are foreseeable or you have notified us of the possibility of such losses.

INACTIVITY TIME

While we make every effort to ensure that the Site is always available, we will not be responsible for any delay, breach, omission or failure on our part that occurs due to a matter beyond our reasonable control, including force majeure situations such as emergency maintenance, internet failures, computer equipment failures, telecommunications equipment failures or other equipment failures, electrical power failures, fires, lightning, explosions, floods, war, labor disputes, sabotage, bad weather, or acts of central government or local or other competent authorities.

We will not be liable if a bet is not placed for any reason or if you are not connected to the Services, including but not limited to computer failures or disconnections, telecommunications services, the internet or otherwise, and your Account balance will always be as recorded on our server. When you log in to the Site, the balance on the server, after being disconnected, will reflect the balance after the completion of the last bet before disconnection.

APPLICABLE LAW

These Terms and Conditions are governed by and interpreted in accordance with the laws of Mozambique. You irrevocably agree that the courts of Mozambique have exclusive jurisdiction to resolve any dispute or claim of any nature arising out of or relating to your use of the Services, and that the laws of Mozambique govern any dispute or claim. However, we reserve the right to bring an action in any jurisdiction where we believe that the violation of our intellectual property rights or violation of these Terms and Conditions took place or originated. ENTIRE CONTRACT

Neither party shall receive compensation for the fact that the other made a false statement, either orally or in writing, prior to the date of conclusion of the contract (unless such false statement was made fraudulently) and the only remedy this situation must be due to breach of contract, as provided for in the Terms and Conditions.
